WonderDays Terms of Service

You may use the App only if you have reviewed and agree to these Terms and the Privacy Policy. If you do not agree, do not use the App. Minors and others who cannot give legally valid consent on their own must obtain consent from a parent, guardian, or other legal representative before using the App. The App does not require account registration.

The App is an entertainment and lifestyle-support service that counts anniversaries stored on your device and displays anniversaries and public information from around the world. It does not provide medical, legal, financial, disaster-prevention, or other professional advice, and it is not a service for reliably managing schedules or deadlines. You are responsible for checking primary sources and managing important dates and plans by another method as well. These Terms also apply to the official website (wonderdays.jp), its celebration planner, and iCalendar (.ics) exports. Planner results and exported events do not update automatically; check important dates yourself.

A congratulations action has no addressee, name, or message and is not delivered to any particular person.

The congratulations total is calculated from congratulations accepted by the server in a scheduled process every five minutes. Startup and processing take additional time, and failures or interruptions may cause further delays. We do not guarantee an update time or maximum delay. Favorite counts are updated when additions or removals are accepted, separately from the scheduled congratulations calculation. The congratulations total includes a fixed initial value of 2, and each item’s favorite count includes a fixed initial value of 1.

Anniversaries, birthdays, names, notification settings, favorites, and read status are stored in the App's local SQLite database and are not sent to our servers. Depending on OS settings, the OS may back up this data and restore it on a new device running the same OS. We do not provide our own backup or transfer between different OSs, and restoration is not guaranteed. Photos selected for cards are temporary and are not stored in this database. Keep a separate record of important information.

We create and update public information and aggregate values, including information about public figures, anniversaries, dates, and sources, to a reasonable extent. However, we do not guarantee their accuracy, completeness, currency, non-infringement, or fitness for any particular purpose. They may contain errors, inconsistent wording, delayed updates, omissions, or aggregation delays. Send requests for corrections, removal, or suspension of publication to wonderdays@happyhack.co.jp.

Rights in photos and other content you use in anniversary cards belong to you or the applicable rights holder. Use only images for which you have the necessary rights. The App invokes OS features so that you can choose a sharing destination, but we do not operate the destination service or control the posted content or its audience.

The App is free to use and contains no in-app purchases or advertising. You are responsible for any costs associated with your device, communications, OS features, sharing destinations, or other external services. If we introduce paid features in the future, we will disclose the applicable conditions and fees in advance and will not charge you without an explicit action by you.

We may accept optional monetary contributions. A contribution is a one-time gift in US dollars. Contributors enter the amount they choose on Stripe's page; no amount is preset. We set no merchant-specific minimum or maximum, but transaction limits imposed by Stripe, the payment method, or other providers apply. We primarily apply received contributions to the development, maintenance, publicly available content, infrastructure, distribution, and operation of WonderDays. HappyHack Inc. determines the specific allocation, timing, and use of any remaining funds at its discretion and may freely use them for other business operations or any other lawful purpose outside WonderDays. Contributors do not gain the right to designate how funds are used, demand a use report, or request the return of unused funds. Whether or not a person contributes, the app features, content, display, support, and terms of use remain the same. No goods, services, benefits, badges, priority support, rights, or other consideration are provided in return.

Before paying, the contributor reviews the recipient, use of funds, no-refund conditions, and Stripe data processing on the public support page. The contributor then confirms the amount and takes the final payment action on the external payment page hosted by Stripe. When the payment succeeds, an agreement is formed between the contributor and HappyHack Inc. to make a gift of that amount under the conditions displayed on the public support page. We do not charge recurring payments.

Except where a refund is required by applicable law, we do not refund contributions for any reason, including a change of mind, duplicate payment, or mistake. Confirm the amount carefully before contributing. For inquiries arising from a legal obligation, we request only the payment date, amount, and information shown in the Stripe email receipt, and never request a card number. The Stripe email receipt is a payment record; it does not certify eligibility for a charitable deduction or other tax benefit.

• Using the App in violation of law, third-party rights, or public order and morals
• Using, storing, or sharing photos or other content without the necessary rights
• Unauthorized access, excessive repeated operations, reverse engineering, tampering, exploiting vulnerabilities, or any other act that interferes with the operation or security of the service
• Using the App or public information in a misleading manner, in a manner that harms a third party, or for a purpose inconsistent with its intended use
• Attempting, assisting, encouraging, or causing a third party to engage in any of the conduct above

Copyright and other rights in the App and in text, images, designs, programs, and other content created by us belong to us or the applicable rights holder. These Terms do not transfer to you any rights beyond those needed for ordinary personal use. Open-source software used by the App is governed by its respective license terms. See Open-source licenses for details.

We may change, suspend, or terminate all or part of the App for maintenance, security, incident response, legal compliance, changes to external services, or other reasonable operational reasons. If this will materially affect users, we will give reasonable advance notice in the App or on a public page, except in emergencies, where needed for security, or where advance notice is otherwise impracticable.

The App is provided free of charge, as is and as available. To the extent permitted by law, we make no express or implied warranty regarding continued availability, uninterrupted or error-free operation, security, accuracy, completeness, currency, fitness for a particular purpose, compatibility with any particular device or OS, preservation or restoration of data, non-infringement of third-party rights, or results of use. This section does not exclude or limit any warranty, right, or liability that cannot lawfully be excluded or limited. You use the App at your own discretion and risk.

The App is provided free of charge. We are not liable for damage where there is no cause attributable to us. To the extent permitted by law, we are also not liable for damage arising from use or inability to use the App, inaccurate information, changes, suspension, or termination of the service, loss of data stored on a device, use of OS features or external services, or disputes between users or between a user and a third party. This does not apply where the damage was caused by our intentional misconduct or negligence, or where liability cannot lawfully be excluded.

If the Consumer Contract Act of Japan applies to the agreement between you and us, the preceding paragraph and other disclaimers do not exclude all of our liability for damages. If our ordinary negligence causes you damage, then, to the extent permitted by law, our liability is limited to direct and ordinary damages actually incurred, up to JPY 10,000. This cap and the other limitations of liability do not apply to damage to life or body, damage caused by our intentional misconduct or gross negligence, or damage for which liability cannot lawfully be limited.

To the extent permitted by law, we are not liable for lost profits, indirect, special, or consequential damages, or other damages that do not ordinarily arise, whether or not foreseeable. This does not apply where the damage was caused by our intentional misconduct or gross negligence, or where liability cannot lawfully be excluded or limited.

If, for reasons attributable to you, you breach these Terms, or if you intentionally or negligently cause damage to us or a third party, you are responsible for the direct and ordinary damages actually incurred that have an adequate causal relationship with the breach or conduct. This does not apply where the matter is not attributable to you or where applicable law does not impose liability.

We may amend these Terms in accordance with law if the amendment serves the general interests of users, or if it is consistent with the purpose of the agreement and is reasonable in light of the need for the change, the appropriateness of the amended provisions, the degree of disadvantage to users and measures to reduce it, and other relevant circumstances. We will announce the amended provisions and their effective date in the App or on a public page a reasonable time in advance. An amendment will not apply retroactively to conduct before its effective date. If applicable law requires individual consent, the amendment applies only after that consent is obtained.

These Terms are governed by the laws of Japan. This does not deprive you of rights under mandatory consumer-protection laws that apply where you live. Only where permitted by law and where you have no mandatory right to bring a claim in another court, the Tokyo District Court or the Tokyo Summary Court has exclusive jurisdiction as the court of first instance over disputes relating to the App.

If any part of these Terms is found invalid or unenforceable under applicable law, the remaining provisions remain in effect. The Japanese version is the authoritative version of these Terms, and translations are provided for convenience. If a translation conflicts with the Japanese version, the Japanese version prevails to the extent permitted by law. This does not limit any protection that mandatory law requires to be provided in the translated language. For questions about these Terms, contact wonderdays@happyhack.co.jp.
